Conditions of Entry:

1.     Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

3.     The promotion commences at Wednesday 3^rd August 2011 and ends at 23.59AEST on Wednesday 31^st  August 2011 (‘Promotion Period’ to be eligible for promotion)

4.     Entry is open to all (‘Eligible Entrants’) excluding: directors, management, employees (and their immediate families) of the Promoter, their advertising agencies and their related bodies corporate;

5.     To enter, participants must either first “like” the Miss Gifted Boutique page on Facebook . Entrants must register their details and answer the question- “ Tell us in 25 words or less what is your favourite Miss Gifted product to keep warm this winter and why? ” Facebook is released from all liability regarding the promotion and is in no way associated with this promotion.

6.     All answers will be judged to determine the winner. Entries will be judged between 1-3^rd September 2011 by management at Miss Gifted Boutique . Entrants responses to the question - “ Tell us in 25 words or less what is your favourite Miss Gifted product to keep warm this winter and why? ” will be judged on their creativity, based upon the panels judgement and discretion.

7.     The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result. The winners will be notified by 4^th September 2011 by phone or email.

8.     The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process. The Promoter reserves the right to request that winners provide proof of identity at the nominated prize delivery address in order to claim their prize.

9.     The prize is a Miss Gifted Winter Gift Pack containing one set of PJs (selected by the winner from the range available online at www.missgifted.com.au) and a cosmetic bag valued at $19.95, and “A Little Love – Body Butter” valued at $6.95 and Take Swipe hand cream valued at $7.95 product products

10. The result of the draw is final and no correspondence will be entered into. The winner name will be published online at www.Miss Gifted Boutique .com.au by 5^th September 2011.

11. The Promoter does not accept any responsibility or liability for any variation in the value of the prizes.

12. The prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize is not transferable to another person (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed as cash.

13. In the event that the winner is under eighteen years of age, the prize will be awarded to the winner’s parent/s or legal guardian.

14. Neither the Promoter, their related bodies corporate, nor their respective officers, employees, contractors or agents will be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for and to the extent that any liability cannot be excluded by law.

15. The Promoter reserves the right review entries in the event of an entrant being unable to satisfy these terms and conditions or forfeiting or not claiming a prize. If a prize remains unclaimed on 5^th September, a new winner will be decided by Miss Gifted Boutique, subject to any written directions given under applicable law. Second winner will be notified by 6^th  September 2011 as per the above terms and conditions of the promotion

16. If for any reason the promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

17. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

18. Entry details remain the property of the Promoter. The name and any photograph of the winners may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting their prize. Entrants consent to the Promoter using and disclosing to its agents, contractors and entities associated with this promotion personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes.

19. By entering the Promotion, entrants acknowledge and agree that, if they are the winner, the Promoter may for the purposes of awarding the prize, publish their name online.

20. Without limited the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available online.
